Trees can sometimes become a source of dispute between neighbours, especially when they obstruct views, block sunlight, or cause property damage. When QCAT Proceedings Are Necessary for Tree Disputes:

QCAT can make binding orders requiring a neighbour to remove or prune a tree if it causes:

  • Serious injury or poses a safety risk to any person.
  • Serious damage to the adjoining owner’s land or property.
  • Significant, ongoing, and unreasonable interference with the use or enjoyment of the adjoining property.
  • Severe obstruction of sunlight to a window or roof of the adjoining home (if the tree is at least 2.5 meters tall).
  • Severe obstruction of a view from the adjoining home that existed when the neighbour took possession of the property (if the tree is at least 2.5 meters tall).

Our fixed-fee package for this service starts at $1,500 plus GST for written advice; claim/defence preparation and accompanying submissions. This fee does not include the QCAT application fee, which is payable separately. QCAT filing fee (claims only) is an additional $380.


Before proceeding with a claim, the neighbour must show they’ve made a reasonable effort to reach an agreement with the tree owner and taken all reasonable steps to resolve the issue, such as contacting the local council.
